- Who we are
This website, viktorum.com (the “Site”), is operated by Viktorum, a digital marketing agency headquartered at 237 Garden City, Nairobi, Kenya, 00618 (“Viktorum,” “we,” “us,” or “our”). We provide digital marketing, brand strategy, web design, SEO and GEO, paid media, email marketing, reputation management, and related services to hospitality businesses (“Services”).
These Terms and Conditions (“Terms”) govern your use of the Site. By browsing the Site, submitting an enquiry, booking a strategy call, or otherwise interacting with us through the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover use of the website itself. Any paid engagement for our Services is governed separately by a signed proposal, statement of work, or service agreement between you and Viktorum, which takes precedence over these Terms in the event of a conflict.
- Eligibility
The Site is intended for business use by hospitality operators, prospective clients, and other visitors aged 18 or older. By using the Site, you confirm you are at least 18 years old and have the authority to act on behalf of any business you represent when submitting an enquiry.
- Intellectual property
All content on the Site, including text, graphics, logos, images, case study results, the “Viktorum Method” and Customer Value Journey framework, and the overall look and feel of the Site, is owned by or licensed to Viktorum and is protected by copyright, trademark, and other intellectual property laws.
You may view and print pages from the Site for your own personal or internal business reference. You may not, without our prior written consent:
- reproduce, republish, or redistribute any part of the Site for commercial purposes
- copy or adapt our branding, methodology names, or marketing frameworks
- use automated tools to scrape or extract content from the Site
- remove any copyright, trademark, or other proprietary notices
Client names, logos, and testimonials shown on the Site are used with permission and remain the property of their respective owners.
- Accuracy of information and results disclaimers
We take reasonable care to keep the Site accurate and up to date, but we make no warranty that the content is complete, current, or error-free.
Statistics, case studies, and figures referenced on the Site (for example, booking uplift percentages, review ratings, or campaign counts) reflect results achieved for specific clients under specific circumstances. They are illustrative only and are not a guarantee, promise, or prediction of results for any other business. Digital marketing outcomes depend on factors outside our control, including but not limited to market conditions, seasonality, competitor activity, platform algorithm changes, and a client’s own operational decisions. Nothing on this Site constitutes a guarantee of any particular booking volume, revenue increase, search ranking, or return on investment.
- Third-party links and platforms
The Site may link to or reference third-party platforms (including but not limited to Google, Meta, Booking.com, TripAdvisor, WhatsApp, and Metricool). We do not control and are not responsible for the content, policies, or practices of third-party sites. Your use of any third-party platform is governed by that platform’s own terms.
- Acceptable use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in a way that breaches applicable law
- attempt to gain unauthorised access to the Site, our servers, or any connected system
- introduce viruses, malware, or other harmful code
- interfere with the proper functioning of the Site
- submit false, misleading, or fraudulent information through our forms
We reserve the right to restrict or terminate access to the Site for anyone who breaches these Terms.
- Enquiries, strategy calls, and no obligation
Submitting a contact form, requesting a marketing audit, or booking a strategy call does not create a binding service contract. A strategy call is a no-obligation consultation. Any paid engagement begins only once both parties sign a separate proposal or service agreement.
- Limitation of liability
To the maximum extent permitted by applicable law, Viktorum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages.
The Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
- Indemnity
You agree to indemnify and hold Viktorum harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
- Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
- Governing law and jurisdiction
These Terms are governed by the laws of Kenya, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Kenya.
Where you are accessing the Site as a consumer or business based in the United Kingdom or the European Union, this clause does not remove any mandatory statutory protections you are entitled to under the law of your own country of residence, to the extent those protections cannot be excluded by agreement.
- Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
